MEMORANDUM OPINION Every year since 2020, Congress has passed and the President has signed an appropriations bill that prohibits the Department of Homeland Security (DHS) from using appropriated funds “to prevent” Members of Congress “from entering, for the purpose of conducting oversight,” any DHS facility “used to detain or otherwise house aliens.” See, e.g., Further Consolidated Appropriations Act, 2024, Pub. L. No. 118-47, div. C, tit. V, § 527(a), 138 Stat. 460, 619.
